Welcome to Lewis Land & Cattle. These Terms of Service (the “Terms”) govern your use of www.lewislandandcattle.com and purchases made through our Shopify-powered online store.

By accessing our website or placing an order, you agree to these Terms and to the policies incorporated into them. If you do not agree, please do not use the website or place an order.

1. About Lewis Land & Cattle

Lewis Land & Cattle is a family-operated farm offering USDA-inspected meats and other farm goods directly to consumers. Our online store is hosted by Shopify, which provides the e-commerce platform used to display and sell our products.

2. Eligibility to Purchase

By placing an order, you represent that:

  • You are at least 18 years old or are placing the order with the permission and supervision of a parent or legal guardian;

  • You have the legal capacity to enter into a binding agreement;

  • The billing, shipping, contact, and payment information you provide is complete and accurate; and

  • You are authorized to use the payment method submitted at checkout.

3. Order Acceptance and Cancellation

Submitting an order does not guarantee acceptance. An order is accepted when Lewis Land & Cattle confirms it for fulfillment or shipment.

We reserve the right, subject to applicable law, to refuse, limit, or cancel an order because of product availability, destination or transit concerns, pricing or listing errors, suspected fraud, payment problems, weather, carrier limitations, or another reasonable business or food-safety concern.

If we cancel a paid order before fulfillment, we will refund the amount collected for the cancelled portion to the original payment method. Customer-requested cancellations are governed by the Return & Refund Policy and any product-specific terms disclosed at purchase.

4. Product Information, Natural Variation, and Availability

We make reasonable efforts to display product descriptions, photographs, estimated weights, quantities, and prices accurately. Because many products are farm-raised, hand-cut, processed in batches, or sold as portions of an animal, natural variation is expected.

Unless expressly stated otherwise:

  • Advertised weights for variable-weight products and beef shares are estimates, not guarantees;

  • Individual cut sizes, package counts, final packaged weights, and the exact mix of cuts may vary;

  • Product images are illustrative and may not depict the exact item received; and

  • Availability is subject to change.

We may limit quantities, substitute an unavailable product with a comparable product of equal or greater value when permitted by the applicable product policy, or discontinue products at any time.

5. Beef Shares

Beef shares represent a portion of an individual animal. Final yield depends on the animal, carcass yield, aging, trimming, bone-in or boneless specifications, processing selections, and other normal processing factors.

Purchasing a beef share does not guarantee a specific final packaged weight, number of packages, cut size, or exact quantity of any particular cut. Any deposit, estimated weight, customization option, balance due date, and fulfillment schedule disclosed on the product page, invoice, or order confirmation becomes part of the purchase terms.

Deposits reserve processing and inventory and are subject to the cancellation and refund terms presented when the share is purchased. Remaining balances must be paid before the order is released or shipped.

6. Pricing and Payment

All prices are stated in U.S. dollars unless otherwise indicated. Applicable taxes, shipping charges, and other disclosed fees are calculated at checkout or included on the applicable invoice.

Payments are processed through Shopify or another payment provider displayed at checkout. Lewis Land & Cattle does not control every aspect of a third-party payment provider’s systems or policies.

We reserve the right to correct pricing, description, or calculation errors. If a material error affects an order that has already been submitted, we may contact you for approval of the corrected terms or cancel and refund the affected portion.

7. Perishable Products

Meat and other refrigerated or frozen products are perishable. By purchasing a perishable product, you acknowledge that:

  • The product requires prompt retrieval, inspection, and proper refrigeration or freezing;

  • Some partial thawing may occur during transit;

  • Partial thawing does not, by itself, establish that a product is unsafe;

  • A product that arrives frozen, partially frozen with ice crystals, or at 40°F or below as measured with a food thermometer may generally be refrigerated or refrozen in accordance with USDA guidance;

  • Appearance or touch alone does not establish a product’s temperature; and

  • Concerns must be reported and documented in accordance with the Perishable Product, Refund & Delivery Policy.

Do not taste or consume a product that arrives above 40°F or otherwise appears unsafe. Follow the documentation and notification procedures in the applicable policy.

8. Shipping and Delivery

Shipping is governed by our Shipping Policy and Perishable Product, Refund & Delivery Policy, each incorporated into these Terms by reference.

We generally ship perishable orders on designated weekdays using UPS Ground or another service selected according to the destination, weather, anticipated transit time, and product requirements. Shipping dates, transit times, and delivery dates are estimates unless the purchased carrier service expressly provides a written guarantee.

Lewis Land & Cattle commits to packing orders appropriately for the anticipated transit, tendering accepted orders to the carrier according to our shipping schedule, and providing available tracking information.

After carrier acceptance, weather events, mechanical failures, routing problems, missed delivery estimates, labor or operational disruptions, and other carrier-related events are outside our direct control. A carrier delay, by itself, does not establish that a perishable product is unsafe and does not automatically qualify an order for a refund, replacement, or credit.

Customers are responsible for:

  • Providing a complete and accurate delivery address and current contact information;

  • Monitoring every tracking number associated with an order;

  • Being available to receive the shipment or arranging prompt retrieval;

  • Bringing every package inside immediately after delivery;

  • Confirming that all separately tracked boxes were delivered;

  • Inspecting the contents promptly; and

  • Refrigerating or freezing the products appropriately upon receipt.

Lewis Land & Cattle is not responsible, to the fullest extent permitted by law, for loss or deterioration resulting from an incorrect or incomplete address, refusal or failure to accept delivery, delayed retrieval, a customer-requested delivery change, failure to monitor tracking, or improper handling or storage after delivery.

9. Perishable Claims, Final Sales, Refunds, and Replacements

All perishable-product sales are final except as expressly provided in the policy applicable to the order or as required by law. Perishable products cannot be returned for resale.

A suspected unsafe temperature, damaged product, missing item, fulfillment error, or other legitimate concern must be reported to Lewis Land & Cattle within 24 hours of confirmed delivery. The customer must provide the documentation required by the Perishable Product, Refund & Delivery Policy, which may include photographs of the exterior box, shipping label, insulation, cold-pack materials, affected products, and a food-thermometer reading.

The 24-hour claim period gives Lewis Land & Cattle an opportunity to document and investigate the concern. Submission of a claim does not guarantee a refund, replacement, credit, or other adjustment.

Partial thawing when the product remains at 40°F or below, normal changes in appearance or texture, customer preference, and carrier delay or disruption outside our reasonable control do not, by themselves, qualify an order for a refund, replacement, or credit.

Each properly documented claim is reviewed individually under the policy in effect when the order was placed and applicable law. When Lewis Land & Cattle determines that an order was lost, damaged, incorrectly fulfilled, or otherwise failed to meet an applicable obligation within our reasonable control, we may provide an appropriate refund, replacement, credit, or other resolution.

Shipping charges are nonrefundable after a perishable order has shipped unless Lewis Land & Cattle approves otherwise in writing or applicable law requires a refund.

10. Risk of Loss

To the fullest extent permitted by applicable law, title and risk of loss for shipped products pass to the customer when Lewis Land & Cattle properly tenders the shipment to the carrier. This provision does not eliminate any obligation that applicable law does not permit us to disclaim and does not excuse an error in Lewis Land & Cattle’s own fulfillment of an order.

11. Local Delivery

Local delivery may be available in designated areas and is subject to the options and charges displayed at checkout. Lewis Land & Cattle does not currently offer on-farm pickup unless expressly stated for a particular order.

Customers must promptly retrieve, inspect, refrigerate, or freeze locally delivered perishable products and report concerns within the timeframe stated in the applicable Return & Refund Policy.

12. Website Accuracy and Availability

We work to keep the website accurate and available, but we do not guarantee uninterrupted or error-free access. Website information may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, availability, promotions, shipping, or other content.

We may correct errors, update information, or modify the website at any time, subject to our obligations for orders already accepted.

13. Intellectual Property

The website and its content—including text, photographs, graphics, logos, product names, designs, and branding—are owned by or licensed to Lewis Land & Cattle and are protected by applicable intellectual-property laws.

You may use the website for personal, noncommercial shopping and informational purposes. You may not reproduce, modify, distribute, sell, exploit, or use our content for commercial purposes without prior written permission.

14. Prohibited Uses

You may not:

  • Use the website or products for an unlawful or fraudulent purpose;

  • Provide false identity, delivery, billing, or payment information;

  • Attempt to gain unauthorized access to the website, accounts, systems, or data;

  • Introduce malicious code or interfere with the website’s security or operation;

  • Scrape, copy, or exploit website content for unauthorized commercial purposes; or

  • Violate another person’s intellectual-property, privacy, or other legal rights.

15. Third-Party Services and Links

Our website may use or link to third-party services, including Shopify, payment processors, shipping carriers, and social-media platforms. Those services may be governed by their own terms and privacy policies.

Lewis Land & Cattle is not responsible for the independent content, availability, security, or practices of a third-party website or service, except to the extent responsibility cannot be excluded under applicable law.

16. Disclaimers

To the fullest extent permitted by applicable law, the website and its online functionality are provided on an “as available” basis. We do not guarantee that website access will be continuous, secure, or free from errors.

Nothing in these Terms excludes food-safety obligations, product warranties, consumer protections, or other rights that cannot lawfully be excluded or limited. Product-specific representations expressly made by Lewis Land & Cattle remain subject to the applicable product description and policy.

17. Limitation of Liability

To the fullest extent permitted by applicable law, Lewis Land & Cattle will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of the website, a third-party carrier disruption, or a transaction governed by these Terms.

To the fullest extent permitted by law, Lewis Land & Cattle’s aggregate liability arising from a product or order will not exceed the amount the customer paid for the specific product or portion of the order giving rise to the claim.

These limitations do not apply where prohibited by law, including to liability that cannot legally be waived or limited.

18. Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless Lewis Land & Cattle and its owners, employees, and affiliates from third-party claims, damages, liabilities, and reasonable expenses arising from your unlawful use of the website, fraudulent conduct, violation of these Terms, or infringement of another person’s rights.

This provision does not require a customer to indemnify Lewis Land & Cattle for Lewis Land & Cattle’s own negligence, unlawful conduct, or breach of an obligation that cannot legally be waived.

19. Governing Law

These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law principles, except when another jurisdiction’s law must apply and cannot lawfully be waived.

20. Severability and No Waiver

If a provision of these Terms is found unenforceable, the remaining provisions will continue to the fullest extent permitted by law. Failure to enforce a provision on one occasion does not waive the right to enforce it later.

21. Changes to These Terms

We may update these Terms by posting a revised version with a new effective date. The Terms in effect when an order is placed will govern that order unless a change is required by law or the parties agree otherwise.

Continued use of the website after revised Terms become effective constitutes acceptance of the revised Terms for future website use. Revised Terms will not be applied retroactively to completed purchases merely because a customer later visits the website.

22. Entire Agreement

These Terms, together with the product description, order confirmation, and policies incorporated by reference, form the agreement governing the applicable order. If a product-specific written term directly conflicts with a general provision in these Terms, the more specific term controls for that product or order.
